§ 12-13. Same—Hours of operation.

(a)

Parks, exclusive of the swimming pool, shall be open daily to the public during the hours of 5:00 A.M. to 11:00 P.M. and it shall be unlawful for any person (other than city personnel conducting city business therein) to occupy or be present in the park during any hours in which the park is not open to the public, unless prior permission is obtained from the city council.

(b)

It shall be unlawful and an infraction for any person to violate this section, and each violation shall be punishable on the first offense by a fine not to fifty dollars, and on a second offense a fine not to exceed one hundred dollars. In the alternative, violations of this section may be punishable by such other remedy available by law or this Code, including the issuance of administrative citations pursuant to Chapter 12C of this Code.
